How to choose a software development partner for Saudi Arabia

What to check when hiring a software development partner for a Saudi project: Sunday to Thursday overlap, 15% VAT, withholding tax, PDPL, Arabic and e-invoicing.

A good software development partner for Saudi Arabia plans around a Sunday to Thursday week, explains 15% VAT and withholding tax on cross-border fees, builds for the Personal Data Protection Law and ZATCA e-invoicing from the start, and delivers Arabic and English properly. Check each point in writing before you sign.

Key takeaways
  • Saudi Arabia works Sunday to Thursday for most organizations and India works Monday to Friday, so shared working days are Monday to Thursday.
  • A Saudi VAT-registered buyer self-accounts for 15% VAT on services from non-resident suppliers under the reverse charge.
  • Payments to non-residents for technical services can attract withholding tax in Saudi Arabia, so ask your accountant before agreeing fees.
  • The Saudi Personal Data Protection Law applies to processing of personal data of people residing in the Kingdom, including by parties outside it.
  • ZATCA e-invoicing is being rolled out in waves, and software that issues invoices must follow its technical rules.
  • Nactore is an AI-native technology and growth company in Mumbai that ships products, websites and AI automation for Gulf buyers and has no office in Saudi Arabia.

What is different about buying software for a Saudi project?

Four things stand out. The working week differs from the UAE and India. Cross-border payments carry tax steps that buyers in other markets do not face. Data protection rules have a clear territorial reach. And invoicing software has to meet technical specifications set by the tax authority. A partner who has read these points will save you weeks of rework.

How much time overlap can a Saudi buyer expect with an India-based team?

Saudi Arabia is on UTC+3 all year and India is on UTC+5:30, so India is 2.5 hours ahead. The bigger difference is the week.

Sunday is a Saudi workday when the India team is off, and Friday is the reverse. Agree a single weekly planning day, and let the team carry urgent Sunday questions to Monday. More tips are in working across time zones.

How does Saudi VAT apply to a foreign vendor's invoice?

Saudi VAT is 15%. ZATCA's guidance says services supplied in the Kingdom to a taxable person by a non-resident supplier are subject to VAT through the reverse charge mechanism, so the Saudi recipient accounts for the VAT. See ZATCA's guideline on imports and exports under VAT. The recipient records output VAT and, where entitled, input VAT on the same return.

A foreign vendor's invoice should therefore show no Saudi VAT, and should carry your VAT registration number. Ask your accountant to confirm treatment for your specific purchase.

Does withholding tax apply to payments to a vendor abroad?

It can. ZATCA's general guideline for withholding tax lists a 5% rate for technical and consulting services and a 15% rate for royalties paid to non-residents. Software licensing and services can be classified differently, which changes the rate. Ask your tax adviser how a double taxation agreement affects the vendor.

For you, the practical step is to decide who bears the withholding and to write it into the contract. The two common options are that the fee is gross and the buyer deducts and remits tax, or the fee is grossed up so the vendor receives the agreed net amount.

What does the Saudi PDPL require from a software vendor?

SDAIA's guide to the Personal Data Protection Law states that the law applies to processing of personal data of individuals in the Kingdom, including processing of data of people residing there by any party outside the Kingdom. It also says small and medium businesses are covered and that a controller must make sure its processors comply. The law came into force on 14 September 2023, with a one-year grace period for compliance. See the SDAIA guide.

That makes a foreign development team a processor in scope. Expect to sign data processing terms, restrict access and agree a transfer basis. Our companion post, Saudi PDPL, data residency and AI, goes deeper.

What about e-invoicing and government work?

If your product issues invoices, it must follow ZATCA's e-invoicing rules. The authority rolls out its integration phase in waves, selected by revenue thresholds, and gives taxpayers advance notice. See ZATCA's roll-out phases page. Ask a vendor whether they have built to the technical specification before.

For government contracts, an official source told the Saudi Press Agency in 2021 that from 1 January 2024 government agencies, institutions and funds would stop contracting with foreign companies whose regional headquarters are outside the Kingdom. If your project is for a state entity, ask your counsel how the current rule, its thresholds and its exceptions affect the contract structure.

Which Arabic and product details matter?

  • Arabic first. Right-to-left layouts, Arabic forms and Hijri date support where relevant.
  • Local payments. Many Saudi consumers expect the national debit network, mada, and local wallets.
  • Saudi consumer rules. The e-commerce law requires clear trader identity and policies, which we outline in e-commerce and marketplace development for the GCC.
Pro tip

Ask for a one-page tax and data note from any vendor, covering VAT treatment, withholding position, data locations and subprocessors. Vendors who have done Saudi work can write it in an hour.

Frequently asked questions

Do we need a Saudi entity to hire a foreign software team?

Not for a normal services contract. Government work and some regulated sectors have extra requirements, so confirm with counsel.

Who pays the withholding tax?

The contract decides. State whether fees are gross or net of withholding and who files the return.

Is Arabic required?

For consumer-facing e-commerce and many public services, yes. Treat Arabic as a core requirement.

Is this legal or tax advice?

No. Confirm every point with Saudi counsel and a licensed tax adviser.

Plan for the week, the tax and the law

A Saudi project works when the calendar, the tax line and the data terms are agreed up front. Nactore builds, ships, ranks and grows as one partner, and tells you plainly what needs a local adviser.
